Permission to Access Network, Hardware, Stored Data and Provide Remote Support

This document and/or use of this remote support service specifically grants Velocity IQ, LLC and Suncoast Data Solutions, Inc. (Hereafter VIQ/SDS) permission and passage to access client's computer and data networks, hardware and all stored data files. This access is granted to facilitate the evaluation of the state of the data stored, currently and/or previously, on computing equipment on said network or system, and to troubleshoot, evaluate, install or remove software on, and/or otherwise service or work on said network or equipment.

This permission is granted fully and willfully by client or person using this website, and said evaluation takes place at client's request. In no event shall VIQ/SDS be liable for any data loss, either currently or previously stored on any computing equipment on client's network, further clarifying and affirming the separation of liability as stated in the Software License and Agreement previously authorized and executed by client.

VIQ/SDS agrees to take all normal precautions to ensure that any personally identifiable information that might become known to us is kept confidential, and that printed or digital information is destroyed following this support session.

NO LIABILITY FOR CONSEQUENTIAL DAMAGES. To the maximum extent permitted by applicable law, in no event shall VIQ/SDS its employees or contractors be liable for any damages whatsoever (including without limitation, direct or indirect damages for personal injury, loss of business profits, business interruptions, loss of business information or any other pecuniary loss) arising out of VIQ/SDS' access to Client's computer(s) or network(s), the use of or inability to use any VIQ/SDS product or service, even if VIQ/SDS has been advised of the possibility of such damages. In any case VIQ/SDS' entire liability under any provision of this agreement shall be limited to the amount actually paid by you for the SOFTWARE and/or VIQ/SDS hardware and/or services used during this single remote support session.

IN NO EVENT SHALL VIQ/SDS AND/OR ITS EMPLOYEES, OFFICERS OR AUTHORIZED VENDORS BE LIABLE FOR ANY SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, DATA OR PROFITS, WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE OR OTHER TORTUOUS ACTION, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF SOFTWARE, DOCUMENTS, PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR INFORMATION AVAILABLE FROM ANY OF VIQ/SDS' WEB SITES OR INFORMATION SERVICES.

This agreement shall be governed by the laws of the state of Florida and shall inure to the benefit of VIQ/SDS and any successors, administrators, heirs, and assigns. Any action or proceeding brought by either party against the other arising out of or related to this agreement shall be brought only in a STATE or FEDERAL COURT of competent jurisdiction located in Lee County, Florida. The parties hereby consent to in personam jurisdiction of said courts.
